ARTICLE 6 – DELIVERY
We send the orders via Aras Cargo.
The SELLER delivers the order within the period it undertakes after it reaches them. The standard delivery period is 7 business days.
However, if a longer maximum period is foreseen in consumer legislation, the relevant legislative provisions apply.
In product sales, the delivery period cannot exceed 30 days as a rule from the receipt of the BUYER’s order by the SELLER.
Nevertheless, the SELLER cannot be held responsible to the extent that there is no fault of the SELLER in delays caused by the cargo company or the BUYER.
ARTICLE 7 – INSPECTION DURING DELIVERY
The BUYER must check the outer appearance of the package when receiving the product.
If there is obvious damage or deformation on the package, the BUYER must report the situation to the cargo personnel. They should also request a damage assessment report to be drawn up if possible.
However, taking delivery of the product does not eliminate the BUYER’s rights regarding defective goods and other consumer rights.
ARTICLE 8 – RIGHT OF WITHDRAWAL
The BUYER can exercise their right of withdrawal within the scope of the Law on the Protection of Consumers No. 6502 and the Regulation on Distance Contracts.
In this context, the BUYER can exercise the right of withdrawal without giving any justification within 14 days from the date the goods are delivered to them or to the third party they designate.
The BUYER can also exercise the right of withdrawal before the product is delivered.
It is sufficient for the BUYER who wants to use the right of withdrawal to clearly state their withdrawal intention to the SELLER.
You can use the following communication channels for notification:
- E-mail: info@rikakalipplastik.com
- Phone: 0322 428 25 25
- Address: Yeşiloba, 46023. Sk. No:42, 01100 Seyhan/Adana
Additionally, specifying your order number in your withdrawal notification helps the procedures progress faster.
ARTICLE 9 – EXERCISE OF THE RIGHT OF WITHDRAWAL AND RETURN OF THE PRODUCT
When the BUYER exercises the right of withdrawal, they must send the product back to the SELLER within the period specified in the legislation, starting from sending the withdrawal notification to the SELLER.
Aras Cargo can be used for return shipments.
In addition, if the carrier specified by the SELLER for return is used, the conditions in the legislation and preliminary information form apply.
If there is no Aras Cargo branch in the BUYER’s location, we can ensure the product is picked up from the consumer within the scope of the conditions specified in the legislation.
ARTICLE 10 – PAYMENT OF THE REFUND AMOUNT
When the BUYER exercises the right of withdrawal in due form, the SELLER refunds the necessary payment according to the conditions specified in the legislation.
In this context, the SELLER refunds the collected product price and delivery costs, if any, to the consumer.
The SELLER performs the refund within 14 days from the date the product subject to the right of withdrawal is delivered to the carrier specified for return.
However, if the BUYER sends the product with a different carrier, the 14-day period starts on the date the product reaches the SELLER in cases specified in the legislation.
Furthermore, the SELLER performs the refund in accordance with the payment instrument used by the BUYER during shopping. This transaction does not bring any expense or additional obligation to the BUYER.
ARTICLE 11 – EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
Relevant legal regulations apply to products and services left outside the right of withdrawal by the legislation.
Particularly, the right of withdrawal cannot be used for products prepared in line with the consumer’s requests or personal needs. Similarly, this right is not valid for products left outside the right of withdrawal within the scope of the legislation.
Therefore, the SELLER informs the BUYER before the order whether the product is within the scope of the right of withdrawal.
ARTICLE 12 – DEFECTIVE GOODS AND CONSUMER RIGHTS
If the delivered product is defective, the BUYER can use their elective rights arising from the Law on the Protection of Consumers No. 6502 and relevant legislation.

In addition, legal rights arising from defective goods are independent of the right of withdrawal in this Agreement.
ARTICLE 13 – OBLIGATIONS OF THE SELLER
The SELLER fulfills the following obligations:
- First, they prepare the product subject to the order in compliance with the characteristics specified during the order.
- Then, they deliver the product within the undertaken period.
- Alongside this, they respect the consumer’s right of withdrawal arising from the legislation.
- When the right of withdrawal is used in due form, they perform the necessary refund within the period specified in the legislation.

If it becomes impossible to deliver the product subject to the order, the SELLER fulfills the obligations foreseen by the legislation.
In such a case, the SELLER informs the BUYER appropriately. They also refund the collected amounts within the period specified in the legislation.
However, the absence of the product in stock does not mean alone that the fulfillment of the order is impossible. In this case, relevant legislative provisions apply.

- Creating orders
- Performing payment transactions

First, the consumer can apply to Consumer Arbitration Committees within the monetary limits determined in the legislation.
However, Consumer Courts have jurisdiction in disputes above the determined monetary limits.
In addition, mandatory legislative provisions regarding the authorized authorities in the consumer’s place of residence are reserved.
ARTICLE 18 – ENFORCEMENT
The BUYER declares that they have read and accepted this Agreement and preliminary information provisions before completing their order via www.rikaplastik.com.
