First of all, the BUYER must complete the payment transaction according to the selected payment method. We also clearly show the payment instruments we accept before the order. In addition to this, we notify the BUYER of any shipping restrictions before the order.

5. DELIVERY INFORMATION

When the order reaches us, we initiate the preparation process. We aim to deliver the order to Aras Cargo within 7 business days at the latest. However, if a longer maximum period exists in consumer legislation, we apply the relevant legislative provisions. Total delivery period in product sales cannot exceed 30 days as a rule. Therefore, it is important that the delivery address specified during the order is accurate and up to date. We send the delivery to the address specified by the BUYER during the order.

6. DELIVERY EXPENSES

We clearly show the cargo and delivery fee, if any, before the order. Furthermore, if additional expenses that we cannot calculate in advance may arise, we inform the BUYER before the order. As a result, the BUYER can see the total amount they will pay before placing the order. We do not request additional payments without obtaining the explicit approval of the BUYER.

7. RIGHT OF WITHDRAWAL

The BUYER can exercise their right of withdrawal within 14 days from the date they receive the purchased goods. Moreover, the BUYER is not obliged to give any justification to use this right. At the same time, they do not pay a penalty clause for exercising the right of withdrawal. Along with this, the BUYER can also exercise the right of withdrawal before the product reaches them.

Calculation of the Withdrawal Period

If we ship products on different dates in a single order, we take the delivery date of the last product as the basis. In addition, in products consisting of multiple parts, we take the delivery date of the last part as the basis.

8. EXERCISE OF THE RIGHT OF WITHDRAWAL

We recommend specifying the order number in the withdrawal notification. You must also specify the name, surname, and the product subject to the right of withdrawal. Furthermore, you can send the withdrawal notification in writing within the withdrawal period. Alternatively, you can also notify via a permanent data storage device.

9. RETURN OF THE PRODUCT

After sending the withdrawal notification, the BUYER must send the product back to the SELLER within 14 days.

The BUYER can use Aras Cargo for return shipment. The SELLER also covers the return cargo fee. However, if there is no Aras Cargo branch in the BUYER’s location, we apply the relevant provisions in the legislation.

10. REFUND OF THE AMOUNT

When the BUYER exercises the right of withdrawal in due form, we refund the product price. We also cover the delivery expenses that must be refunded within the scope of the legislation. We perform the refund transaction to the payment instrument used by the BUYER during the purchase. Thus, the BUYER does not undertake any additional expense or obligation. Consequently, if the right of withdrawal is exercised in due form, we carry out the relevant payments in accordance with the legislation.

11. SITUATIONS WHERE THE RIGHT OF WITHDRAWAL CANNOT BE USED

The legislation brings exceptions to the right of withdrawal for certain products and services.

Main Exceptions

• Products prepared with the special request of the consumer
• Products prepared according to personal needs
• Perishable goods
• Products whose expiration date may pass
• Products whose protective packaging has been opened after delivery and whose return is unsuitable in terms of health or hygiene
• Products that mix with other products after delivery and cannot be separated
• Other products and services left outside the right of withdrawal by the legislation

Particularly, opening the packaging in standard plastic storage containers, shelves, gratings, and similar products does not eliminate the right of withdrawal on its own. However, the conditions specified in the legislation must occur for the exception to apply.

12. DEFECTIVE PRODUCTS

When the BUYER receives a defective product, they can use their legal rights. These rights are based on the Law on the Protection of Consumers No. 6502 and related legislation. In addition, the BUYER’s legal elective rights are reserved. Along with this, we do not impose return expenses on the consumer in the return of defective products.

13. LOSS AND DAMAGE IN DELIVERY

The SELLER is responsible for loss and damage occurring until the delivery of the product. This responsibility continues until the product is delivered to the BUYER or to the third party designated by the BUYER. However, if the BUYER specifically requests us to use a different carrier, the relevant legislative provisions apply. In this case, the responsibility arising from the transportation process is evaluated according to the relevant legislation.

14. OUR INABILITY TO DELIVER THE PRODUCT

If it becomes impossible to deliver the product subject to the order, we inform the BUYER. The SELLER informs the BUYER in writing within 3 days from the date they learn about the situation. The BUYER can also receive this notification via a permanent data storage device. In such a case, we refund the collected payments within the period specified in the legislation. However, the absence of the product in stock does not mean alone that performance is impossible.

16. DISPUTES

The BUYER can use their legal rights within the scope of the Law on the Protection of Consumers No. 6502. Accordingly, the consumer can apply to the Consumer Arbitration Committee depending on the nature of the dispute. They can also apply to the Consumer Court in disputes above the monetary limits valid for the relevant year. Therefore, the consumer must check the current monetary limits of the relevant year before application.

17. ACCEPTANCE OF PRELIMINARY INFORMATION

Before completing their order, the BUYER reads and examines this Preliminary Information Form. The BUYER also accepts that they have received the information presented to them before the contract is established. Along with this, the BUYER completing the order clearly sees that a payment obligation arises. Therefore, we clearly and understandably show the payment obligation right before the order confirmation. As a result, the BUYER completes their order by examining this information.
